These Terms & Conditions ("Terms") govern your access to and use of the BongoPOS website and platform (the "Service"). By creating an account, subscribing to a plan, or using the Service in any way, you agree to be bound by these Terms. If you do not agree, please do not use the Service.
The Service only provides calculations of your business. It does not perform automatic taxation on receipts and does not remit any taxes directly to the Tanzania Revenue Authority (TRA) or any other authority. To issue legally valid fiscal receipts, you must use a TRA verified EFD (Electronic Fiscal Device) machine. Any tax figures shown by the Service are estimates for your internal bookkeeping only and do not satisfy fiscal receipting requirements.
We provide a cloud-based point of sale, inventory and business management platform covering the entire website, including but not limited to: the landing pages, pricing, registration and subscription flow, the POS, inventory, sales, purchases, customers, suppliers, expenses, accounting, reports, the customer portal, and the administrator portal. We may add, change, suspend or discontinue features at any time.
You must be at least 18 years old and capable of entering into a binding contract to use the Service. You are responsible for safeguarding your credentials and for all activity under your account, including activity by your employees and team members. Notify us immediately of any unauthorized use. You must provide accurate and complete business and owner information during registration.
Plans are billed monthly or yearly as shown at the time of subscription. Payment is due in advance using the payment methods displayed at checkout. You can cancel at any time; access continues until the end of the paid period and is not refundable on a pro-rata basis unless required by law. Coupons, promotions and prices are subject to change. Plan upgrades and renewals are subject to your current plan tier.
You retain ownership of all business data you enter into the Service, including products, prices, customers, sales and reports. The Service stores and processes this data only to provide and improve the Service to you. You are responsible for ensuring that your data and your use of the Service comply with all applicable laws, including tax and data protection laws.
The Service provides accounting and calculation tools for your internal business records. It is not a tax agent and does not calculate, collect, withhold or remit VAT, income tax, withholding tax, or any other tax to TRA or any other authority. Receipts or invoices printed or sent from the Service are business documents only. For transactions that require fiscal receipts under Tanzanian law, you must issue the receipt from a TRA verified EFD machine. You are solely responsible for registering your business, keeping tax records, filing returns and paying taxes as required by law.
Do not use the Service for unlawful activity, to store unlawful content, to infringe the rights of others, to attempt to gain unauthorized access, to interfere with the Service or other users, or to circumvent any feature, limit or security control. We may suspend or terminate accounts that violate these rules.
The Service may integrate with third-party payment providers, gateways, mobile money operators, banks and other services. Your use of those services is governed by their own terms. We are not liable for the acts or omissions of third-party providers, including failed, delayed or reversed payments.
All software, design, content, branding, documentation and materials of the Service are owned by us or our licensors and are protected by intellectual property laws. You may not copy, modify, reverse engineer, resell or distribute the Service except as expressly permitted.
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose and non-infringement. To the maximum extent permitted by law, we are not liable for any indirect, incidental, special or consequential damages, or for any loss of profits, revenue, data or goodwill. Our total liability is limited to the amount you paid to us in the 12 months preceding the event giving rise to the claim.
The Service does not provide legal, accounting or tax advice. Calculations, reports and tax figures are provided for your convenience only and should be independently verified. You remain responsible for the accuracy of your records and for complying with all regulatory requirements applicable to your business, including the use of a TRA verified EFD machine for fiscal receipts.
You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you breach these Terms, if your subscription is unpaid after any applicable grace period, or if required by law. Upon termination you may export your data during a reasonable transition period.
We may update these Terms from time to time. We will post the updated Terms on this page with a new "Last updated" date. Continued use of the Service after changes are posted constitutes acceptance of the revised Terms.
These Terms are governed by the laws of the United Republic of Tanzania. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Tanzania.
